General Terms and Conditions for Ticket Buyers

These terms apply to ticket buyers. For event organizers, see General Terms and Conditions for Organizations.

1. Definitions

In these General Terms and Conditions, the following terms are defined as:

  • Tiqqo: The trade name of E-asy Concepts B.V., registered with the Chamber of Commerce under number 87210320, with its registered office at Ambachtshof 88, Nootdorp, The Netherlands.
  • Organizer: The natural person or legal entity that organizes an event and offers Tickets for sale via the Platform.
  • User: The natural person or legal entity that purchases one or more Tickets via the Platform.
  • Platform: The online environment of Tiqqo where Users can purchase Tickets and Organizers can offer events.
  • Ticket: The digital or physical proof of access to an event.
  • Purchase Agreement: The agreement between the User and the Organizer for the purchase of Tickets.
  • Service Fees: The costs charged by Tiqqo to the User for the use of the Platform.
  • Transaction Costs: Variable costs charged by the payment service provider depending on the payment method chosen.
  • Total Price: The total amount paid by the User, consisting of the ticket price, Service Fees, and Transaction Costs.

2. Applicability of the Agreement

  1. These General Terms and Conditions apply to all Services of Tiqqo and the use of the Platform by the User.
  2. By using the Platform and/or purchasing Tickets, the User agrees to these General Terms and Conditions.
  3. Tiqqo reserves the right to unilaterally amend these General Terms and Conditions. Changes will be announced at least 30 days in advance.
  4. Deviations from these General Terms and Conditions are only valid if expressly agreed in writing.

3. Purchase Agreement

  1. The Purchase Agreement is established between the User and the Organizer. Tiqqo acts solely as an intermediary.
  2. By completing a ticket purchase, the User enters into a direct agreement with the Organizer.
  3. Tiqqo is not responsible for the execution of the event or the quality thereof.
  4. The Ticket is provided electronically to the User immediately after payment.
  5. Each Ticket contains a unique code that grants access to the event.
  6. The User must be able to show the Ticket (digitally or physically) at the entrance of the event.
  7. Tickets are personal and may not be resold or transferred without permission from the Organizer.
  8. Tiqqo and/or the Organizer may invalidate Tickets if these terms are violated.

4. Price and Payment

  1. The Total Price consists of:
    • The ticket price as determined by the Organizer;
    • Service Fees charged by Tiqqo;
    • Transaction Costs depending on the chosen payment method.
  2. All prices are inclusive of VAT unless stated otherwise.
  3. The Total Price is clearly displayed before the User completes the purchase.
  4. Payment must be made immediately upon completion of the order.
  5. Tiqqo offers various payment methods, including but not limited to:
    • iDEAL;
    • Credit card (Visa, Mastercard);
    • PayPal;
    • Apple Pay;
    • Google Pay.
  6. After successful payment, the User receives a confirmation email with the Tickets.
  7. If payment fails, the order is automatically cancelled.

5. Refunds and Cancellation

  1. Tickets cannot be returned to Tiqqo. Any refund requests must be directed to the Organizer.
  2. The Organizer determines the refund policy for their events.
  3. Service Fees and Transaction Costs are in principle non-refundable.
  4. In case of event cancellation by the Organizer:
    • The User is entitled to a refund of the ticket price;
    • The Organizer is responsible for processing refunds;
    • Tiqqo may assist in the refund process but is not obligated to do so.
  5. Tiqqo is not liable for any additional costs incurred by the User, such as travel or accommodation costs.

6. Liability

  1. Tiqqo acts solely as an intermediary and is not liable for:
    • The quality or execution of the event;
    • Cancellation or modification of the event;
    • Actions or omissions of the Organizer;
    • Loss or theft of Tickets.
  2. Tiqqo's liability is limited to a maximum of €500 per incident.
  3. Tiqqo is never liable for indirect damage, including but not limited to:
    • Consequential damage;
    • Lost profits;
    • Missed savings;
    • Reputational damage.
  4. The User indemnifies Tiqqo against all third-party claims related to the use of the Platform.
  5. Liability limitations do not apply in case of intent or gross negligence by Tiqqo.

7. Privacy and Data Protection

  1. Tiqqo processes personal data in accordance with the General Data Protection Regulation (GDPR).
  2. When purchasing Tickets, Tiqqo collects the following data:
    • First and last name;
    • Email address;
    • Phone number (if required);
    • Payment information.
  3. Personal data is used for:
    • Processing the ticket order;
    • Sending Tickets and order confirmations;
    • Communication about the event;
    • Compliance with legal obligations.
  4. Personal data may be shared with:
    • The Organizer of the event;
    • Payment service providers;
    • Authorities if legally required.
  5. The User has the right to:
    • Access their personal data;
    • Correct incorrect data;
    • Delete data (right to be forgotten);
    • Object to processing;
    • Data portability.
  6. For privacy-related questions, the User can contact privacy@tiqqo.com.

8. Event Cancellation

  1. The Organizer is responsible for informing Users about event cancellation or changes.
  2. Tiqqo may assist in communication but is not obligated to do so.
  3. In case of cancellation:
    • The User should first contact the Organizer;
    • If the Organizer does not respond, the User can contact Tiqqo;
    • Tiqqo will mediate but cannot guarantee refunds.
  4. Tiqqo is not liable for damages resulting from event cancellation.

9. Intellectual Property Rights

  1. All intellectual property rights to the Platform and related materials belong to Tiqqo or its licensors.
  2. The User may not:
    • Copy, modify, or distribute Platform content;
    • Use automated systems to access the Platform;
    • Reverse engineer the Platform;
    • Remove copyright notices.
  3. The Organizer's event information and branding remain their property.
  4. By purchasing Tickets, the User receives only the right to attend the event.

10. Applicable Law and Disputes

  1. These General Terms and Conditions are governed by Dutch law.
  2. Disputes will first be attempted to be resolved in mutual consultation.
  3. If consultation does not lead to a solution, the User can:
    • Submit the dispute to the competent court in Amsterdam;
    • Choose mediation through the Foundation for the Settlement of Automation Disputes (SGOA);
    • Use the European ODR platform for online dispute resolution.
  4. Tiqqo is affiliated with no guarantee scheme.
  5. The costs of legal proceedings are borne by the losing party, unless the court decides otherwise.

These General Terms and Conditions have been filed with the Chamber of Commerce and can be downloaded from our website.

If any provision of these terms is found to be invalid, the remaining provisions shall continue to apply.

In case of discrepancies between translations, the Dutch version prevails.
